Anwar: Top official could not be touched

 



The above is the headline in yesterday’s, 6.8.2023, Daily Express.

Prime Minister Datuk Seri Anwar Ibrahim is determined to put a stop to corrupt practices and irregularities which he said seemed to have become systemic and damaged the previous administration.

He claimed that the previous governments were beset by the practice of officials asking for a ‘commission’.

I have avoided talking about ‘commission’ as I have no evidence of the same. But, I have questioned how DBKK approved the Vistana Heights project that flouted many of the laws - rules and regulations - in the Housing and Town Development Authority Enactment.

 

The developers, Topwira Corporation Sdn Bhd, did not do anything about my complaint to them about defects pointed out to them within a month of obtaining the keys.

The developers said that they will wait for the court decision on the claims by house buyers for Liquidated Ascertained Damages.

What has a case claiming liquidated ascertained damages against the developer got to do with complaints against building defects. Don’t legal advisors use their brains to think? Doesn’t PAM have officers who can think instead of saying that they could not act because of a case in court against the developer?

After repeated requests to the Ministry of Housing a meeting was held on 10.3.2023. At the meeting, the developers were told to raise the height of the road to facilitate car access to the porches.

Only the driveway to my son's house was reconstructed in May 2023 together with the repair works to my son's house that I had complained in January 2020.

The repair work was not done correctly and when asked to redo the work I was told that the defect liability period is over. Believe me, this is what was stated in a letter written by the developer’s lawyer.

If the Housing Authority ordered the repair works, is that the end of their responsibility? Why do we have such a department with so many officers and employees if they cannot even follow up on such a simple exercise?

Many questions have not been answered and do I have to take this matter to court to have it resolved?

Why do innocent house buyers have to put up with such attitudes of ‘Top Officers’?

Why did DBKK approve a project when the developer had cut corners by not cutting down the house platforms according to the original development plan? The platform for house S9 was supposed to have been reduced by about 5 feet.

Why did DBKK approve the driveways that could not be accessed?

Why has it taken more than 7 months for Lembaga Jurukur Sabah to investigate my complaint that the as-built survey is fabricated to obtain the occupancy certificate?

Why has the professional body – Board of Engineers Malaysia – yet to make a decision on my complaint.(See note below)

Why does the Housing Ministry not even do a simple thing such as checking if there are complaints to work carried out and accept stupid statements by the developer that the defect liability period is over when in fact the repairs were done one month after the defect liability period was over?

I am not a racist but I am beginning to ask myself how only one of 26 houses bought by a Malay have so many problems that are not faced by the other non-Malay buyers?

1.     Leaking pipes that existed even before handing over the keys.

2.     Ceiling fan points throughout the house without hooks for fixing the fans.

3.     Water splashing on the floor into the kitchen despite so-called repair work.

4.     Floor tiles that are not appropriately fixed to the floor.

Datuk Seri Anwar should investigate the culprits involved in this scam instead of house owners having to fork out money to sue the developer, DBKK, and the professionals involved in this project. 

Note: Added on 9.8.2023. The Board of Engineers had sent me a letter dated 30.7.23 and posted on 2.8.23 and received by me today. The letter says there is no case against the consultant Engineers. I must respond within 14 days of the date of the letter. That effectively gives me 5 days from the receipt of the letter.  I wrote to them on 23.2.3023 and they reply now and give me 5 days to reply. This is how stupid some of our professionals have become.
