My email to the mayor hours before the scheduled meeting at 2.30pm at KKTP

                           My meeting was scheduled for 2.30 pm on 5.8.2025. I sent off the following email to the mayor at 5am on the same day. This was so he is informed. Concerns Regarding Sabah Surveyors Board 's Response to Complaint From:luqmanm2002@yahoo.co.uk To:pejabatmayor.dbkk@gmail.com Tue 5 Aug at 04:52 Dear Datuk Mayor,   I received a letter dated 15 July 2025 from Datuk Sr. Bernard Liew Chau Min , Chairman of the Sabah Surveyors Board, in response to my complaint lodged on 15 December 2022. The delay of over two and a half years in addressing this matter raises serious concerns about the efficiency of our statutory bodies and their ability to drive progress in Malaysia .

In the article, Governor Tun Musa Aman, expressed his vision for Sabah to be governed with integrity, accountability, and wisdom, underpinned by sustainable development plans that prioritise the well-being of its people.

Headline: Malaysia Should Adopt UK’s Corporate Manslaughter Law, Says Ramli Amir.

                                                             In a recent Jesselton Times report , Ramli Amir urged Malaysia to adopt a corporate manslaughter law similar to the UK’s to hold companies accountable for fatal negligence. Ramli criticized Malaysia’s current legal framework, which lacks a specific offense for corporate manslaughter, making it challenging to prosecute companies. He explained: “The law requires proof that a ‘controlling mind,’ such as a director, was personally responsible, which is often difficult to establish. This gap leaves victims’ families without justice and allows companies to escape accountability for gross management failures leading to deaths.”

2nd Meeting at DBKK

A follow-up meeting to the one held on 5 May 2025 took place on 11 June 2025. The Director instructed me to commission an as-built survey to prove that the survey conducted by the licensed surveyor for the Vistana Heights project was falsified. I responded that I had tried to find a surveyor, but none were willing to take on the task. The Director then suggested hiring a surveyor from West Malaysia.

Developers typically engage Licensed Surveyors (LS) for three distinct phases of a construction project: pre-construction (e.g., boundary and topographic surveys), construction phase (e.g., setting out and progress surveys), and post-construction “as-built” surveys (to verify that the constructed project aligns with approved plans). While it’s not mandatory to use the same surveyor for all phases, developers often prefer a single LS for continuity, efficiency, and cost-effectiveness. My thoughts: Why was Jurukur Terra Firma engaged to do the as-built survey when the sales and purchase agreement had the name of Jurukur Bakat? Would this not be considered a breach of contract?

S. Dzulkarnain S. Abdillah, On 15.12.2022, I complained about the fabricated As-built survey plan for Taman Puncak Vistana. This was followed up with several emails to and from LJS/me, and is attached below. How is it that the Board is still looking into this complaint after over two years? What further verification do you need and from which authority? I demand a reply within one month of the date of this email as this is the last of the information I require before proceeding with legal action. Thank you and kind regards, Luqman Michel

Malaysia - wait and see attitude by government departments

  It is now 2 months since my last post on this blog. I have tried everything I can think of since 2019 when the keys were handed over to me. The wait and see attitude of our government departments of Malaysia is deplorable. 

Vistana Heights Site Visit by Lembaga Jurukur Sabah

  I complained to Sabah Surveyors Board about the fabrication of the as-built survey drawing on 15.12.2022.   On 28.6.2023, 6 months after my complaint, the Committee members of the Sabah Surveyors Board (Lembaga Jurukur Sabah) came for a site visit and took some survey points to determine the height difference between the road and the house platform.

  On 15.12.2022, I handed a complaint letter together with the As-built Survey, Original Development Plan and Amended Development Plan as well as my explanation of the discrepancy to Lembaga Jurukur Sabah (Sabah Surveyors Board).   It is now more than 5 months and the answer I got from them is that the investigation has not been completed.   I don’t understand why it take such a long time to do a simple examination. My main complaint is that the As-built- survey plan does not reconcile with the on-site situation.   Why isn’t the investigation not completed even after 5 months? What is there to investigate?   A Survey Department should be able to get a licenced surveyor to survey a few points and determine if the as-built survey plan submitted to obtain the Occupancy Certificate is correct.   Here are the correspondences between me and Lembaga Jurukur Sabah.
