Inquiry Regarding Potential Conflict of Interest in Legal Representation

  The following is my email to the AG's office seeking clarification. luqman michel   From: luqmanm2002@yahoo.co.uk To: sagchambers@sabah.gov.my Mon 28 Apr at 08:43 Dear Sir,   In November 2022, I received correspondence from Messrs. Ronny Cham and Co., claiming to represent Topwira Corporation Sdn Bhd, as well as Puan Rosemary Ahping, General Manager of LPPB, and Puan Della E. Sinidol of LPPB. I sought confirmation from Puan Rosemary and Puan Della regarding whether they authorized Mr. Ronny Cham to act on their behalf, but received no response. LPPB has not clarified whether Mr. Ronny Cham represents the individuals or the organization, leaving his role unclear.

The meeting with KKTP on 10.3.2023 – Part 1

  The meeting on 10.3.2023 on the Vistana Heights issues highlighted a few important matters: i.                      the Local government and housing authority (KKTP) confirmed that the infrastructure has not been taken over by DBKK. ii.                    KKTP confirmed that the defect liability period is not over due to the Covid 19 extension. iii.                  the road was ordered by KKTP to be raised so that the driveways are not steep. iv.                  the bank guarantee deposited by the developer has not been released.

Vistana Heights House owners’ predicament

  I have been trying to organise a meeting between house owners and the developer, Topwira Corporation Sdn Bhd. to discuss issues that matter. I am in receipt of a letter from a lawyer acting on behalf of the developer which states that I have no right to represent my son living in the US who has bought a house in Vistana Heights. The letter states that I or the other purchasers may proceed to engage Solicitors to communicate with their clients on any matter touching on the Taman Puncak Vistana.

i.                      Confusing statements The letter computing the Liquidated Damages dated 16.10.2019 showed the developer as Topwira Corporation Sdn. Bhd and the landowner as Lembaga Pembangunan Perumahan dan Bandar (LPPB). However, the occupancy certificate dated 2 nd October 2019 shows that the buildings on the land are owned by Topwira Corporation Sdn. Bhd. (Extracted from My Story Part 2) I am confused as to who is the land owner. My first question to Puan Della (The development officer of LPPB) when a few house owners and I met her in her office was – ‘What is the role of LPPB in this project?’ Her answer was ‘Land owner’. Despite being a land owner, LPPB has not signed on the S&P as required in the Housing Development (Control and Licensing) Rules 2008.
