Meeting with BIGoNS (Sabah Integrity Department) on 12.8.2025

On 6 August 2025, I received a call from BIGoNS inviting me to attend a meeting on 12 August 2025.The meeting proceeded as scheduled. During the session, the chairman assured me that the minutes would be provided by the following Friday. Drawing from prior experiences with other government officials, where such documents have often been delayed, I proactively sent an email to BIGoNS on 13 August 2025, outlining the key discussions to ensure an accurate record. The following matters were discussed: Attendees were: Puan Siti Fairuz , Puan Jennifer, Puan Andrea , Enc. Fauzi , my wife Mariam and me. The meeting was chaired by Puan Andrea.

                           My meeting was scheduled for 2.30 pm on 5.8.2025. I sent off the following email to the mayor at 5am on the same day. This was so he is informed. Concerns Regarding Sabah Surveyors Board 's Response to Complaint From:luqmanm2002@yahoo.co.uk To:pejabatmayor.dbkk@gmail.com Tue 5 Aug at 04:52 Dear Datuk Mayor,   I received a letter dated 15 July 2025 from Datuk Sr. Bernard Liew Chau Min , Chairman of the Sabah Surveyors Board, in response to my complaint lodged on 15 December 2022. The delay of over two and a half years in addressing this matter raises serious concerns about the efficiency of our statutory bodies and their ability to drive progress in Malaysia .

Datuk James Ratib,   I am writing in response to your recent remarks at the Varsha Integrity Programme, as reported in the press , where you raised concerns about "dishonesty without intent" in the public sector. While I commend your commitment to fostering integrity and accountability through initiatives like the Varsha Integrity Programme, I respectfully disagree with the notion that certain instances of dishonesty in public service can be classified as unintentional. Drawing from my ongoing experience with governance issues at the Vistana Heights development in Kota Kinabalu, I believe some actions reflect deliberate misrepresentation or negligence that cannot be excused as lacking intent. Below, I outline specific examples to illustrate my concerns, which undermine public trust and contradict the integrity you advocate.

MINUTES OF MEETING with DBKK on 11th June 2025 (Part 2)

    Tatal kebawah untuk:  Translasi ke dalam Bahasa Melayu Other matters: The minutes: 2.12 Puan Mariam, wife of Mr. Luqman Michel (representative of Lot S9 owner), expressed discomfort with the condition of the access road to Lot S9 due to its steep gradient.   2.13 Madam Siti Fairuz from the Sabah State Integrity and Governance Division (BIGONS) informed that, following the discussions and explanations provided in the meeting, the complaint submitted to BIGONS has been closed.

Item 2.1 i) states the platform height (paras tanah) to be 101 feet. Item 2.1 iii) states the platform height (paras tanah) to be 106.26 feet. This is what should be highlighted. The difference in platform height is 5.26 feet. 

"Unveiling Discrepancies: Delays and Deceptions in the Vistana Heights Survey Saga"

  At the meeting with DBKK together with the surveyor and architect the Director General, Sr. Lifred Wong asked the surveyor to do a survey of the platform and road heights at no 9 Vistana Heights. Since then, I have requested for the survey and have yet to receive it. As mentioned earlier, Sr. Lifred Wong tried to mislead those present with figures that were not in the original as-built drawing.  LINK

My second email to the Assistant Minister to the Chief Minister - Datuk Abidin Madingkir

  Dear Datuk Abidin Madingkir, I read an article that said several of the statutory bodies are under your purview in your role as Assistant Minister to the Chief Minister. The article further said that you go on rounds to ensure the effective operations of government machinery. In addition to serving as Mayor of Kota Kinabalu from 2011 until 2016, you were also Permanent Secretary to various ministries such as the Local Government and Housing. Datuk you approved the development of Vistana Heights in 2011 when you were the mayor. The development plan was checked by Datuk Alijus Sipil. 

Explanation of my email to the Chief Minister (Part 2)

  ‘…the driveway is too steep and not in accordance with the Original Development Plan approved by DBKK.’ The original development dated 1995 and the development plan attached to the Sales and Purchase Agreement dated January 2014 show the platform height as 101feet whilst the development plan dated 2018 shows the platform height as 106.26 feet. This gives a difference of 5.26 feet resulting in the steepness of the driveway. Datuk Sr. Lifred Wong when asked why the site was not cut down to the height as per the development plan attached to the Sales and Purchase agreement cited rocky ground as the reason.

  Despite frequent discussions on transparency and integrity by prominent leaders such as Chief Minister Datuk Hajiji, Governor Tun Musa Aman, and the Sultans of Perak and Pahang in newspapers and social media, the actions of some civil servants and heads of statutory bodies in Sabah appear to fall short of these principles. Since 2022, I have highlighted several instances on my blog that contradict the Chief Minister’s repeated calls for transparency and accountability. Below are a few examples:

  Background: The inquiry pertains to concerns regarding a potential retaining wall at Vistana Heights, where a cliff exceeds 20 feet in height behind residential properties, and associated interactions with the Dewan Bandaraya Kota Kinabalu (DBKK). I raised questions about the necessity and planning of a retaining wall, discrepancies in development plans, and DBKK’s lack of response to specific queries.
