Luyang DAP Vistana Heights

Image
This morning, I saw a video clip by YB Phong Jin Zhe. There were 742 ‘likes’ which could simply mean they have all seen it. But there were 69 minus 1 positive comments and 120 shares. I was the only non- Chinese who had commented and my comment was liked by one FB member. I will tag some of them in my post here and see if they have anything to say or shut up as usual.

luqman michel  <luqmanm2002@yahoo.co.uk> To: mayor@dbkk.sabah.gov.my Thu, 23 Feb at 08:31   Dear Datuk Mayor,   I wrote to you about the steep driveway to my son's house (S9, Lot 15) at Vistana Heights, Ira Manis (refer to my email below forwarded to you at the request of your PA on 8.9.2022.) This morning, 23.2.2023, I saw another extension of the driveway, by more than one foot, of another house. Please let me know if there are new laws that allow house owners to extend their driveways onto the road.

A stitch in time saves nine On 22.12.2022 I decided to email PAM giving them details as promised in my email to them on 15.10.2022. This is a lengthy email for those interested in the details. PAM did not respond. Dear Sirs, I refer to my previous emails to you. As promised to you in my email dated 15 October 2022 I now have more details from a study of the original development plan and as-built survey received from DBKK and Amended development plan obtained from LPPB. The original development approved by the authorities, DBKK, was not adhered to. Road heights and platform heights were changed and fabricated as-built survey plans and amended development plans were submitted to the authority for obtaining occupancy certificates. Here are emails to and from a house buyer and the architect.

Reply from Pertubuhan Arkitek Malaysia (PAM)

I wrote to PAM Sabah and did not receive a reply. So, I wrote to Pertubuhan Arkitek Malaysia on 29.8.2022 and received a response on 14.10.2022 as follows: Professional Practice Committee <practice@pam.org.my> To:luqmanm2002@yahoo.co.uk Fri, 14 Oct 2022 at 10:52   Dear Mr. Luqman, We refer to your query as received on the 29th August 2022 and would reply as follows: 1.   Please accept our apologies for the delay in replying. The delay though was a result of our trying to obtain a bit more information regarding the technical issues behind your query. 2.   Based on the information received from PAM's Sabah Chapter, we understand that the Architect in question has already provided his findings and replied to the Developer regarding the issues which you have highlighted. Under normal circumstances, we would advise that you pursue your queries as such, with the Developer or the local authority tasked with control of the construction of the property. 3.   We h

Should architects be responsible for construction gone wrong?

I spoke with Jonathan Lee of LYS Arkitek on 22.7.2022 and followed up with an email on 1.8.2022. I asked for explanation on 3 matters including the following (the third matter): 3. The driveway is too steep for a Proton Waja to drive up to the car porch. Who is responsible for this? Is there a maximum gradient for the driveway that an architect/ engineer should adhere to? I am informed that the approach road is not laid to the required level as per the original drawings. Please confirm if the road is built as per your drawings. I would appreciate a response from you as soon as possible so that I may take the appropriate action. I wrote two emails to Zls Engineering Management Sdn Bhd on 5th and 12th January 2021 requesting information on the question above and did not receive any response. I have also spoken with an engineer from Zaidun Leeng on the above 3 matters and he has assured me that he will get back to me once he has discussed the matter with his boss once

My reply to Ronny Cham & Co's email.

Image
Ronny Cham & Co replied to my email dated 20.1.2023 and said that they had no further instruction from their client Rosemary and Della of LPPB. I replied their email with the following on 30.1.2023 and resent it on 16.2.2023 and have not heard from them.  This is for record purposes to be included in my next book.

My emails to Ronny cham &Co and their response

I believe I have enough material to write my fourth book. I am recording this here so that I can copy paste when I am ready to publish my book.  Mr. Ronny Cham wrote an email to me on 25.11.2022 stating that he is acting for Rosemary Ahping and Della E. Sinidol of Lembaga Pembangunan Perumahan Dan Bandar (LPPB). He said that I had caused to publish in my Facebook account and in my luqman.blogspot.com libelous and defamatory remarks concerning his clients.  He asked me if I was prepared among other matters: to propose a reasonable compensation to our clients, of not less than RM2 million each, considering the fact that our clients have been put to immediate loss and damage, shame and ridicule, irreparable disparity and injury to their reputation, professional integrity and good will, and a possibility of loss of employment and deprivation of a reasonable livelihood for them and their families.

Summary of stages I have travelled

Image
A summary of events to date. We can reach the top of a mountain via various routes. Some ways may be easier than others but will lead to the same destination. If there are 7 different ways to reach the top, we won’t use all 7 ways at once. We may try one way today and another, another day. Many of my friends think that I am too harsh or too direct with my approach to dealing with the Vistana Heights issues. For the information of new readers, I have taken more than 3 years to come to where I am currently at on the Vistana Heights issues.

Questions and answers from LPPB’s spokesman, Mr. Andy Osman

The following questions were asked before the meeting at LPPB on 16.11.2022 with the developer, engineers, architect and others. Answers were provided after the meeting. Luqman:   Why does the as built plan differ from the original DP? Andy:         Yes I will get the architect to explain (If it differs) Luqman:    Yes. It differs greatly. Here is Andy’s response after the meeting:
