2nd Meeting at DBKK

A follow-up meeting to the one held on 5 May 2025 took place on 11 June 2025. The Director instructed me to commission an as-built survey to prove that the survey conducted by the licensed surveyor for the Vistana Heights project was falsified. I responded that I had tried to find a surveyor, but none were willing to take on the task. The Director then suggested hiring a surveyor from West Malaysia.

However, I have two concerns regarding this directive:

In Sabah, title surveys can only be legally conducted by surveyors licensed and registered with the Sabah Surveyors Board, as stipulated in the Surveyors Ordinance 1960 and its regulations. Therefore, employing a West Malaysian surveyor for a title survey in Sabah is not feasible.

 

I question why I should be responsible for arranging this survey. As the one challenging the survey’s accuracy, it is the responsibility of the Land and Survey Department (LJS) to adjudicate and resolve the issue. DBKK should abide by LJS’s decision. It is not my duty to find a surveyor for LJS; they must address my complaint dated 15 December 2022 themselves. LJS’s response that they are awaiting "the authority" is unacceptable.

The following email to Lembaga Juruukur Sabah details my predicament:

Dear Miss Fung Yun Ling,

Executive Officer, Sabah Surveyors Board,

Kota Kinabalu, Sabah.

 

I am writing to express my profound dissatisfaction with the Sabah Surveyors Board’s handling of my complaint, initially lodged on 15 December 2022, concerning the fabricated as-built survey by Jurukur Terra Firma for the Vistana Heights Phase 1 Project. Despite numerous correspondences, a site inspection on 28 June 2023, and over two years of follow-ups, I have yet to receive a substantive resolution or the promised survey report from the inspection.

Your most recent communication, dated 15 January 2025, merely states that the Board is “still looking into” the matter, citing “further verification from the authority.” This vague response, after such an extended period, is unacceptable and suggests a lack of urgency or accountability in addressing a serious allegation of professional misconduct. The fabrication of survey plans is a grave issue with significant implications for the integrity of the project and public trust in your oversight.

I have repeatedly requested the survey report from the 28 June 2023 site visit, which was conducted in the presence of licensed surveyors and Board members. This report is critical for my intended legal action against the developer and all other professionals concerned, including the Sabah Surveyors Board, which must be initiated by October 2025 to avoid being time-barred. Your failure to provide it, despite assurances, hinders my ability to seek justice and transparency.

I demand the following within seven days from the date of this email:

 

A copy of the survey report from the 28 June 2023 site inspection, including all relevant survey drawings and data.

A detailed update on the investigation’s progress, including specific actions taken since my original complaint and a clear timeline for resolution.

Confirmation of whether the as-built survey reconciles with the on-site conditions, as per my repeated inquiries.

Should I not receive a satisfactory response by 21 April 2025, I will have no choice but to escalate this matter further. This includes lodging a formal complaint with the Minister of Works, the Prime Minister’s Office, and other relevant authorities, as well as pursuing legal avenues to address the Board’s apparent inaction.

I urge you to treat this matter with the seriousness it warrants. I await your prompt reply.

Dalam bahasa Tamil, kami berkata, "Muzhu Poosanikkaayaich Sotrukkul Maraikkirargal!" yang diterjemahkan sebagai "Cuba menyembunyikan labu keseluruhan dalam sepinggan nasi!" (முழு பூசணிக்காயை சோத்திலே மறைக்க முடியாது). Ini bermakna cuba melakukan skandal, penipuan, atau kenakalan dan menutupinya dengan alasan yang lemah. Itulah yang berlaku di mesyuarat DBKK pada 11 Jun 2025.

Sijil pendudukan untuk Vistana Heights dikeluarkan berdasarkan tinjauan as-built dan pelan pembangunan yang dipalsukan. Dengan lebih empat tahun memantau kes ini, pengalaman saya membolehkan saya mengesan pembohongan hampir serta-merta. Saya bukan pemula.

Kebenaran tidak boleh ditimbus oleh ideologi. Inilah yang berlaku:

Syarat Dialog yang Keterlaluan: Pemaju dan LPPB enggan bertemu dengan pemilik rumah melainkan kami menyewa dewan mesyuarat hotel dan membawa peguam, jurutera, arkitek, juruukur, dan media sendiri. Tuntutan yang tidak masuk akal ini hanya untuk membincangkan aduan pemilik rumah adalah tidak boleh diterima.

Respon Mengelak PAM: Pertubuhan Akitek Malaysia (PAM) mendakwa mereka tidak boleh mengulas soalan saya kerana kes mahkamah yang sedang berlangsung mengenai ganti rugi ditentukan (LAD). Namun, mereka memberikan alasan berbeza apabila saya mengemukakan soalan sama selepas kes selesai.

Tuntutan Tidak Wajar LAM: Lembaga Arkitek Malaysia meminta saya menyediakan tinjauan tahap spot, walaupun ia mudah diperoleh daripada Lembaga Juruukur Sabah (LJS), yang menjalankan tinjauan pada Jun 2023, atau daripada arkitek. Saya telah menyerahkan tinjauan itu, tetapi masih menunggu respons mereka.

Taktik Menangguh LJS: LJS sedang menyiasat aduan saya pada Disember 2022 mengenai tinjauan as-built yang dipalsukan. Respons mereka pada 15 Januari 2025 menyatakan: "Lembaga masih mengesahkan aduan anda mengenai pelan tinjauan as-built untuk Taman Puncak Vistana, Iramanis, dengan pihak berkuasa berkaitan." Sehingga 16 Jun 2025, mereka belum menjelaskan siapa "pihak berkuasa" ini. DBKK mengesahkan ia bukan mereka—jadi siapa?

Dakwaan Tidak Berasas DBKK: DBKK mengarang angka untuk membenarkan ketepatan tinjauan as-built, yang tidak masuk akal. Cadangan mereka supaya saya mengupah juruukur dari luar Sabah untuk tinjauan hak milik melanggar peraturan LJS. Mengapa DBKK tidak mendesak LJS untuk mengenal pasti "pihak berkuasa" misteri yang mereka tunggu?
