Gazette to stop abuse of duty and power by Developers

                                                                     


On 28.9.2030 there was an article in the Daily Express on higher penalties imposed by Sabah to prevent abandoned projects


Here are some excerpts and my comments:

It was noted that previously, besides licensed developers, there were also fly-by-night non-local operators in cahoots with Sabahan partners, whose firms were not members of the Sabah Housing and Real Estate Developers Association (Shareda).

Topwira, the developer of Vistana Heights is not a member of Shareda. 

 

Pending gazettement the amendments to the Housing Development Enactment 1978 were passed in the State Assembly on Aug 10, 2023.

‘It is to deter irresponsible developers who abandon their projects and to stop them abusing their duty and power.’

I hope Mr. Stanley Chong Hon Chung, Deputy Permanent Secretary of the Sabah Ministry of Local Government and Housing would put his money where his mouth is. He ordered the developer of Vistana Heights to repair what we had complained of. The repair works were carried out after the defect liability period was over. The repair to the eaves at the back of the house was not done properly and water still drops on the floor opposite the open kitchen space and splashes into the kitchen. When I complained about it to the developer, the developer's lawyer said that the defect liability period is over. If this is not abuse of the duty and power of a housing developer, then nothing is.
