Subject: Clarification on Development Plans for Vistana Heights Phase 1

Dear Ar. Lee Yik Soon,

I am preparing documents for my son Faisal’s lawyers and have been reviewing information related to Vistana Heights Phase 1, including posts on my blog. I need your clarification on several matters.

In 2022, I contacted Puan Tantinny (DBKK), Puan Rosemary Ahping, and Puan Della Sinidol (LPPB) to inquire about any additional development plans. I received no replies, but Puan Zaliezah Raskan of LPPB informed me on 31 October 2022 that she was aware of only one Development Plan, dated 27.11.2006 (Siri No. DP/002/11.06), which was provided to me by DBKK.

Upon reviewing the documents you submitted to LAM on 6.3.2023, I noted a Development Plan prepared in August 2018 and signed by Datuk Yeo Boon Hai on 8.10.2018. This is the "Revised Development Plan" mentioned in your letter to LAM dated 6.3.2023. The Original Development Plan, dated July 1995 and signed by the mayor on 27.11.2006, was not included in the documents you provided to LAM. My son Faisal relied on this 1995 plan for his purchase.

Additionally, I am puzzled by the as-built survey plan dated 24.9.2018 but plotted only on 25.4.2019. On 22 October 2018, the C&S consultant noted that the surveyor was amending the as-built drawings for submission to local authorities for inspection and OC application. Could you clarify:

What amendments were required for the as-built drawings?

Why does the Revised Development Plan (August 2018) differ from the as-built survey plan (24.9.2018, plotted 25.4.2019)?

Why was the Original Development Plan (July 1995) excluded from the documents submitted to LAM?

Your assistance in clarifying these discrepancies is greatly appreciated.

Are architects liable for fabricated documents submitted to authorities

In 2020, many of my well-meaning friends told me that I have no course of action against the professionals involved in obtaining the Occupancy Certificate for Vistana Heights project with fabricated as-built survey plan. I believe all those involved, including DBKK senior officers, LPPB (Lembaga Pembangunan Perumahan Dan Bandar) and its GM Rosemary Ahping, Arkitek LYS, Lembaga Juruukur Sabah etc. will be answerable for how the Occupancy Certificate was issued. Hopefully, my complaint to SPRM (MACC), LJS, DBKK, Lembaga Arkitek Malaysia will be looked into.
