Q&A: Meeting at Dewan Bandaraya Kota Kinabalu (DBKK) on May 5, 2025

Question to DBKK: Why was the platform height for houses at Vistana Heights not reduced to the level specified in the original development plan? Why were house buyers not consulted regarding this alteration?

DBKK’s Response: Changes to the plan were made due to the presence of rocks at the site.

Follow-Up Questions Arising from DBKK’s Response:

·        The engineer stated that a soil test was conducted before construction. Why was the 1995 development plan prepared without accounting for these conditions?

 

·        Despite the project being 75% complete in 2014, as confirmed by the architect, why were the platform heights, in the development plan attached to the 2014 Sale and Purchase Agreement (S&P), unchanged from the 1995 plan?

 

·        Is it lawful to provide a development plan in the S&P that differs from the actual on-site conditions when the project is 75% complete?

 

·        The land behind lots D17 to D18 collapsed before 2011. Why does the 2018 development plan not reflect this collapse in the drainage reserve? Why does the As-Built Survey (ABS) show the drainage reserve as it was in the 1995 plan, ignoring the collapse?

 

·        The developer informed Faisal that a retaining wall would be built behind lots D18 to D17. When asked, DBKK verbally stated this was not mandated by them. However, multiple emails to DBKK seeking written clarification on this matter have gone unanswered.

 The minutes stated the following:

       The approval record of the Retaining Wall Plan for this development shall be reviewed to identify if there is a proposal for the provision of a retaining wall at the rear of Lot S9 for information and reference in the upcoming meeting.

        Action by: DBKK Engineering Department and DBKK City Planning Department.

This is a misrepresentation of my question. My question was if there was a proposal for the provision of a retaining wall behind D17 to D18 which were numbered in the initial development plan as S1 to S18.  

This was not answered by either the DBKK Engineering Department or DBKK Planning Department.

Soalan kepada DBKK: Mengapa ketinggian platform untuk rumah-rumah di Vistana Heights tidak dikurangkan mengikut tahap yang ditetapkan dalam pelan pembangunan asal? Mengapa pembeli rumah tidak dirujuk mengenai perubahan ini?
 
Jawapan DBKK: Perubahan kepada pelan dibuat kerana kehadiran batuan di tapak tersebut. 
 
Soalan Susulan Daripada Jawapan DBKK:
 
• Jurutera menyatakan ujian tanah telah dijalankan sebelum pembinaan. Mengapa pelan pembangunan 1995 disediakan tanpa mengambil kira keadaan ini? 
 
• Walaupun projek telah siap 75% pada tahun 2014, seperti yang disahkan oleh arkitek, mengapa ketinggian platform dalam pelan pembangunan yang dilampirkan dalam Perjanjian Jual Beli (S&P) 2014 tidak berubah daripada pelan 1995? 
 
• Adakah sah di sisi undang-undang untuk menyediakan pelan pembangunan dalam S&P yang berbeza daripada keadaan sebenar di tapak apabila projek telah siap 75%? 
 
• Tanah di belakang lot D17 hingga D18 runtuh sebelum 2011. Mengapa pelan pembangunan 2018 tidak mencerminkan keruntuhan ini di kawasan rizab saliran? Mengapa Ukur As-Built (ABS) menunjukkan rizab saliran seperti dalam pelan 1995, mengabaikan keruntuhan tersebut? 
 
• Pemaju memaklumkan kepada Faisal bahawa dinding penahan akan dibina di belakang lot D18 hingga D17. Apabila ditanya, DBKK secara lisan menyatakan ini tidak diwajibkan oleh mereka. Walau bagaimanapun, beberapa e-mel kepada DBKK untuk mendapatkan penjelasan bertulis mengenai perkara ini tidak dijawab. 
 
• Rekod kelulusan Pelan Dinding Penahan untuk pembangunan ini perlu disemak untuk mengenal pasti sama ada terdapat cadangan untuk menyediakan dinding penahan di belakang Lot S9 untuk maklumat dan rujukan dalam mesyuarat akan datang.
 
• Tindakan oleh: Jabatan Kejuruteraan DBKK dan Jabatan Perancangan Bandar DBKK.
Salah tafsir soalan saya: Soalan saya ialah sama ada terdapat cadangan untuk menyediakan dinding penahan di belakang D18 hingga D17 yang dinomborkan dalam pelan pembangunan awal sebagai S1 hingga S18.
 
Soalan ini tidak dijawab oleh Jabatan Kejuruteraan DBKK atau Jabatan Perancangan DBKK.
