Luqman Michel, I can say that this part "Further, since you have extended your complaints to numerous professional bodies, government ministries & Departments, including newspapers, it is your responsibility to ensure that every such recipient of your complaints must be present at the meeting. Please let us have a copy of them to evidence that you have invited them to the meeting." is not correct as whether these people come or not is beyond your control and to put such a condition clearly shows the developer is not interested to talk by putting up these barriers.
Since there is a dispute about DEFECTS then it must go according to the contract, usually there is a defect period upon which the buyers can chase with the developer else is gone. As I said before the politicians in Sabah is the problem here as they allowed the imbalance relationship with developers and buyers/consumers. So next time you go to vote, remember which political party is not prepare to do justice for buyers in Sabah. Even if you go to Court for defects issue chances is low unless it is negligence. That is, the house collapsed after heavy rain or the area get flooded frequently because it was built on catchment area etc.
Why do they need (a) lawyer; (b) an engineer; (c) an architect and a (d) surveyor or to invite relevant parties, such as DBKK. Ministry of Local Government and housing etc.
So basically, the lawyer is saying to you that he will NOT deal with you? Is it because you are not the buyers' representative? But anyway, there is a Housing Tribunal as you know, why didn’t the buyers go there?
Luqman Michel
Thank you for your valuable input.
I went to the tribunal but they said they don't deal with cases involving above a certain amount. As for the lawyer he was simply stone-walling. This matter does not have to go to court as it would be embarrassing to the present government.
My note now:
Read the letter from the lawyer HERE.
