Chief Minister Hajiji Noor, responding to media queries on June 18 about assemblymen facing charges, emphasized his administration’s dedication to upholding the law and fostering integrity among government officials and public servants. The article quotes him stating that the Gabungan Rakyat Sabah (GRS) coalition was founded on a promise of transparent and competent governance following years of political instability.

The report further notes that GRS has not shielded anyone from scrutiny or interfered with enforcement agencies, expressing confidence in the rule of law. The government pledges to remain transparent with the public and media, ensuring Sabahans are informed and not left in the dark. It asserts that GRS’s strength lies in addressing challenges with principle and clarity, staying focused on its mission to serve the people.

Yet, I have been raising concerns since 2022 about the occupancy certificate for Vistana Heights, which I believe was issued based on a fabricated as-built survey. This survey not only contains falsified road height measurements but also indicates a drainage reserve in an area where the land has collapsed. Furthermore, the development plans appear to have been manipulated—a matter I intend to address separately.

Email correspondence, copied below, between myself and Lembaga Jurukur Sabah (LJS) raises questions about the integrity and transparency touted by the Chief Minister. If there is no interference from party leaders, as claimed, who is the mysterious “Authority” LJS is waiting for before responding to my complaint lodged on December 15, 2022, regarding the fabricated survey report? I seek clarity on this matter. 

Additionally, during the 74th birthday celebration of Sabah’s Head of State, Tun Musa Aman, he urged all levels of administration to uphold integrity to maintain public trust. He emphasized governing with “full integrity, trust, and wisdom” and prioritizing sustainable, people-centered development. However, these words ring hollow when the Sabah Housing and Town Development Board (LPPB Sabah), responsible for housing and urban development, has yet to address my complaint about its surveyor, which I lodged on December 15, 2022. Again, who is the “Authority” referenced in LJS’s letter dated January 14, 2025?

Moreover, how can the government claim to uphold public trust when Dewan Bandaraya Kota Kinabalu (DBKK) fails to respond to emails complaining about the occupancy certificate issued based on allegedly falsified development plans and as-built surveys? I respectfully request the transparency promised by the Chief Minister and the integrity championed by the Head of State to be demonstrated in addressing these serious concerns.

On 28.6.23, after several requests, you came to Vistana Heights and inspected the road level and house platform. Licensed surveyors surveyed the road level and the house platform level in the presence of several board members of LJS.

I was promised to be given a survey report, and you have not produced one to date.

Today, I received an email from Lembaga Arkitek Malaysia asking for a survey report.

I have asked them to obtain a copy from your office as that would be the most practical thing to do.

Please extend me a copy of the survey you carried out on 28.6.23.

I refer to my original complaint to you dated 15.12.2022. You ought to be well aware by now that the survey plan submitted to DBKK was fabricated.

I request you to respond to this email within a week from today.

How is it that the Board is still looking into this complaint after over two years?

What further verification do you need and from which authority?

I demand a reply within one month of the date of this email as this is the last of the information I require before proceeding with legal action.

I am writing to express my profound dissatisfaction with the Sabah Surveyors Board’s handling of my complaint, initially lodged on 15 December 2022, concerning the fabricated as-built survey by Jurukur Terra Firma for the Vistana Heights Phase 1 Project. Despite numerous correspondences, a site inspection on 28 June 2023, and over two years of follow-ups, I have yet to receive a substantive resolution or the promised survey report from the inspection.

Your most recent communication, dated 15 January 2025, merely states that the Board is “still looking into” the matter, citing “further verification from the authority.” This vague response, after such an extended period, is unacceptable and suggests a lack of urgency or accountability in addressing a serious allegation of professional misconduct. The fabrication of survey plans is a grave issue with significant implications for the integrity of the project and public trust in your oversight.

I have repeatedly requested the survey report from the 28 June 2023 site visit, which was conducted in the presence of licensed surveyors and Board members. This report is critical for my intended legal action against the developer and all other professionals concerned, including the Sabah Surveyors Board, which must be initiated by October 2025 to avoid being time-barred. Your failure to provide it, despite assurances, hinders my ability to seek justice and transparency.

I demand the following within seven days from the date of this email:

A copy of the survey report from the 28 June 2023 site inspection, including all relevant survey drawings and data.

A detailed update on the investigation’s progress, including specific actions taken since my original complaint and a clear timeline for resolution.

Confirmation of whether the as-built survey reconciles with the on-site conditions, as per my repeated inquiries.

Should I not receive a satisfactory response by 21 April 2025, I will have no choice but to escalate this matter further. This includes lodging a formal complaint with the Minister of Works, the Prime Minister’s Office, and other relevant authorities, as well as pursuing legal avenues to address the Board’s apparent inaction.

I urge you to treat this matter with the seriousness it warrants. I await your prompt reply.
