Dear Ms. Monica,

I refer to our discussion on 12.5.2022 at Puncak Vistana.

I told you that my car (Proton Wira) when reversing into my son's house (number 15) had the front bumper scraped against the road.

You retorted that it was because my car was low.

I found that answer rather ridiculous as that is a standard car. The car was unable to go up without scraping the bumper because the driveway is too steep.

I asked if you had a solution to this problem and you said that I could expand the road entrance like that done by the house owner at number 19.

Pray tell me why this expansion should be at the expense of the house buyer when the problem is one due to construction fault.

I then asked you if you would permit the house to be sold. You replied that you would grant permission for the house to be sold only if the LAD compensation is agreed to be reduced.

I replied that this response from you is unacceptable to me. I don't understand why a discount on the LAD should be given before you consent for the house sale.

I then requested you to think further on this matter and revert.

I have been trying to resolve a few questions in my mind on problems encountered on the purchase of a house by my son, Faisal Luqman at Vistana Heights.

The developer of Vistana Heights does not cooperate and does not answer questions raised.

I spoke with the architect Mr.Jonathan Lee of Arkitek LYS on 22.7.2022 who said that he will revert but did not. I emailed him on 1.8.2022 and he has yet to respond.

3. The driveway is too steep for a Proton Waja to drive up to the car porch.

Who is responsible for this?

Is there a maximum gradient for the driveway that an architect/ engineer should adhere to?

Sir, a notice has been issued to owners of the units/houses in Vistana Heights that no renovation or repairs may be done outside the fence of the unit. If we cannot drive a standard car up the driveway what are the alternatives we have.

I believe it is not appropriate for unit/house owners to have to fork out money to repair driveways constructed by the developer which cannot be accessed by standard cars.

You state, in your email, that you have spoken to the developer. I too have spoken to the developer on this matter on 12.5.2022 and written an email to them on 14.5.2022, complete with a photograph of my Proton Waja on the driveway, which has yet to be responded to.

She informed me that the 'Puncak Vistana 1' road is not under the jurisdiction of JKR.

Sir, I would be grateful if you could let me know what course of action you are taking on this matter.

I have been going to the house for 2 years without being able to drive up to the car porch.

I have written to the Engineers and the architect concerned. The engineer has referred the matter to the developer and the architect has not replied.

I have also written to IEM and PAM who have yet to respond.

I hope the buck will stop here and you will resolve this matter.

Dear Sir,

Not getting a satisfactory response from Mrs. Lee, I wrote to the engineers on this matter on 5.1.2021.

For Mrs. Lee to say that I had not complained to her before the expiry of the defect liability period is misrepresentation.

Mrs. Lee had said that Topwira Corporation Sdn Bhd has been sued by some of the house buyers and that she will wait for the outcome of the court case before acting on my complaints.

On 12.5.2022 I spoke about the driveway being too steep for my Proton Wira to access it. She retorted that my car is too low. I then wrote an email to Topwira Corporation Sdn. Bhd. which has yet to be responded to.

Subsequently, I discussed this matter with Ms. Jessie Lee who said that the management team is discussing this matter and that she will revert. I have not heard from her or Mrs. Monica Lee on this matter since.

On 4.10.2022, I met with you in your office and you asked me to write my complaints and email you. Please find attached:

i.                     Complaints on house no 15 (S9) specifically and construction at Vistana Heights, Ira Manis, in general.

ii.                   Details of emails mentioned in i. above.

The occupation certificate issued by DBKK on 2.10.2019 states that the project was approved ‘upon confirmation of the Consultants that the buildings and infrastructure works has been completed in accordance with their design and supervision as per approved/endorsed plan.’

My question to the professionals involved in the project on whether the completed work is consistent with the design as per the approved plan has never been answered.

I believe the original plan submitted to DBKK has been approved by DBKK but is the completed work consistent with the original endorsed plan?

I believe the professionals should have monitored the work at the construction site and checked that the work was carried out according to the drawings submitted to DBKK.

Did the professionals who prepared applications for statutory approval state the deviation, if any, from the original endorsed plan?

Re: Original Development plan for development of Vistana Heights Phase 1

I would be grateful if I may purchase a copy of the original development plan submitted to DBKK as the development plan on the S&P agreement is not clear.

I understand that the construction of the infrastructure deviates from the original submission. This has resulted in the driveway to house no 15 and several other houses too steep for standard cars to drive up to the car porch.

I would be grateful if you could also confirm if a retention wall was designed behind the houses on the left hand side of the Puncak Vistana 1 road in the original plan. There is a steep fall of more than 20 feet behind the perimeter fence.

i. The driveway leading to my house and many other houses is too steep for standard cars. I have been unable to drive up to my car porch since OC was issued in October 2019.

v.  Many questions to DBKK, including how OC was issued when many of the house owners are unable to drive up the driveway, have not been answered.

vi. We have discovered that the work done is not in accordance with the approved development plan.

Despite several emails and reminders, the above problems have not been resolved by the developer or the professionals concerned.

A few of the house owners and I would be grateful if you could arrange a meeting immediately between your officers, the developer and the professionals to amicably resolve the problems.

I met up with your Puan Zaliezah Raskan this morning and explained to her my concern about the construction of Vistana Heights Phase 1. She said that she is aware of my email to aduan.lppb@sabah.gov.my.

I have been informed by officers at DBKK that the only approved Development Plan in their office is the DP dated 27.11.2006 that was handed over to me. The no Siri is DP/002/11.06.

I was informed by your Puan Zaliezah Raskan at this morning’s meeting that she also knows of only the DP dated 27.11.2006.

The above DP is different from the DP attached to the S&P agreement provided to my son Faisal Luqman on the purchase of house no. 15 (S9).

The DP shows the road at 100’ and the car porch to be 101’. However, the existing road and car porch are not consistent with the approved DP.

There is no retaining wall constructed behind houses No S10 downwards to house no S1. Kindly confirm if there was a retention wall designed or otherwise. A steep fall of more than 20 feet without a retention wall looks precarious.

I, on behalf of some of the owners of houses at Vistana Height Phase 1 would like to have a meeting among you, Topwira Corporation Snd. Bhd, the management of Vistana Heights and any other concerned parties, as soon as possible.

On 28.10.2022, I obtained the Approved Development Plan for Vistana Heights, DP No: DP/002/11.06 dated 29.11.2006, from your office.

I was informed by your officers that there is no subsequent/ amended DP to the one given to me.

On 31.10.2022, I was also informed by an officer, Puan Zaliezah Raskan, of LPPB that the DP above is the only one approved by DBKK that is in her possession.

I would be grateful if you could confirm that the above is the only DP and that there is no amended DP. This is important as the road level and the car porch level for my house no 15 (S9) on the approved DP are 100' and 101' respectively.

The as-built gradient of the driveway is not consistent with that of the DP.

I am not quite sure what your role is in housing development but your vehicles were seen at Vistana Heights when Topwira Corporation Sdn. Bhd. was announced as winding up.

Phase 1 of Vistana Heights was completed and OC was obtained in October 2019. Keys were handed over to me for a house (S9) purchased by my son, Faisal Luqman.

Request for a meeting with LPPB, the house owners, the developer and their consultants have yet to occur.

I have been unable to move into my house since receiving the keys in December 2019 because the driveway is too steep.

I request you look into my complaints as well as other owners' complaints before the developer is allowed to commence phase 2.

Dear YB Datuk Masidi Manjun,

A number of houses have steep driveways where standard Malaysian cars cannot be driven up to the car porch.

Since cars could not go up the driveway, two house owners widened the driveway and were still unable to drive their cars up to the car porch. They then tore up the driveway and rebuilt it and extended it by 2 to 3 feet onto the road. This is dangerous to other road users. The developer had complained to DBKK about the driveway extensions. DBKK engineers visited the site but have not done anything about the extended driveways.

I complained to the developer about not being able to drive up the driveway of Faisal’s house. When no response came from them, I wrote to the engineers and the architect and they asked me to refer the matter to the developer. Similarly, DBKK officers who visited the site said that this should be undertaken by the developer but there has still been no repair to the road from which the driveway extends. I reported this matter to LPPB, the joint venture developers of this housing project, but they have also not done anything to appease us.

Datuk, I beg you to look into this problem immediately.

As it is, the road leading to the houses is dangerous to drive. What more if more of the house owners decide to extend their driveways like that done by the two house owners.

There should be a solution to this mess up by the developer and the authorities.

You said that you are acting on behalf of Rosemary Ahping and Della E. Sinidol of Lembaga Pembangunan Perumahan Dan Bandar (LPPB). I have written to Rosemary and asked her if she had instructed you to act on behalf of LPPB and I have had no response. The legal officer at LPPB said that you are not on the panel of lawyers of LPPB. Please confirm if you did receive written instruction from Rosemary to act for LPPB.

You further mentioned that ‘the development of the said Taman Puncak Vistana was under the jurisdiction of the Housing Controller Sabah of the Housing and Local Government Ministry, and in accordance with the Housing Development (Control and Licensing) Enactment 1978 and the rules made thereunder’. Could you please let me know where you got this notion from?

You ought to know that many of the rules had been broken by the developer, Topwira Corporation Sdn Bhd. Among the many rules broken are the few mentioned below:

First Schedule

i.                     h) Plans approved and cannot be changed

The plans for the Project and the property has been duly approved by the Appropriate Authority and no alterations to the approved plans shall be made or carried out except as may be required by the Appropriate Authority.

Mr. Cham, the original development plan was approved by the approving authorities (DBKK). Were the alterations made instructed by the Appropriate Authorities?

ii.                   (i) Good workmanlike manner in accordance with plans and specifications

The property shall be constructed in a good workmanlike manner in accordance with the specifications and plans approved by the Appropriate Authority and agreed to by and between the Purchaser and the Developer. No change thereto or deviation therefrom shall be made without the consent in writing of the Purchaser except as may be required by the Appropriate Authority…

DBKK approved the development plan based on falsified as-built survey plans by the surveyor, Jurukur Terra Firma and fabricated amended development plan by the architect, Arkitek LYS. The consultant engineers, Zaidun Leeng (Sabah) Sdn. Bhd also has a hand in this scheme.

YAB. Datuk, many of the house owners are unable to drive up the driveway as the driveway is too steep and not in accordance with the Original Development Plan approved by DBKK.

Two of the house owners have extended the driveway onto the road which should be considered illegal as they are a road hazard. What has DBKK done about this illegal extension despite complaints from the developer?

Thank you for your email dated June 16, 2025.

I obtained the as-built survey for Vistana Heights from DBKK on November 15, 2022, and received a duplicate from LAM on March 21, 2023. I presented this copy to Mr. Lifred Wong during the DBKK meeting on June 11, 2025, and Mr. Rayner from DBKK confirmed it matched his records.

The minutes from the May 5, 2025 meeting indicate a 2.76 ft difference between the platform height of Lot S9 and the interpolated road height from the 2018 development plan. When Mr. Lifred asked if I agreed with this figure, I stated the height difference exceeds 4 feet. At the June 11, 2025 meeting, Mr. Lifred referenced a height of 31.05m (101.87 ft), resulting in a 4.38 ft difference (106.25 – 101.87). I disputed the figure 31.05m as it does not appear on the as-built survey. I continue to question whether the as-built survey was altered to secure the Occupancy Certificate.

Further questions I have raised with Mr. Lifred, which remain unanswered, are as follows:

i.                    The Development Plans (DPs) dated 1995, 2007 (approved in 2011), and 2018 indicate a 9-foot drainage reserve behind houses D18 (previously S1) to D17 (previously S18). However, this drainage reserve does not exist on-site.

ii.                  The As-Built Survey (ABS) also depicts this non-existent drainage reserve. An ABS should accurately reflect the actual site conditions.

iii.               The ABS shows the boundary of the back wall of unit S8 as shorter than that of S9, with units S7 to S3 being even shorter than S8. This difference is not reflected in any of the DPs, including the latest DP dated 2018.

I am writing with reference to a report in The Star dated 10 June 2025, which outlined the prohibition on public officers making statements that could potentially embarrass or tarnish the government’s reputation, as well as restrictions on disclosing factual information related to government operations. I fully respect and appreciate the intent behind these guidelines.

I am reaching out to seek your guidance on a matter concerning a property I am maintaining, purchased by my son, for which the occupancy certificate was issued in October 2019. Unfortunately, there are significant issues with the property that have yet to be resolved despite my best efforts to address them amicably.

The driveway to the house is excessively steep and poses safety concerns, as it does not comply with the specifications outlined in the Sales and Purchase Agreement or the original development plan. Additionally, a retaining wall, promised by the developer and mandated by the Dewan Bandaraya Kota Kinabalu (DBKK), has not been constructed, rendering the house unfit for occupancy. Despite my repeated requests to the developer and architect to rectify the driveway gradient and construct the mandated retaining wall, no progress has been made.

In December 2022, I lodged a complaint with the Lembaga Juruukur Sabah (LJS) regarding the as-built survey plan, which I believe was inaccurately prepared to obtain the occupancy certificate. On 28 June 2023, representatives from LJS, including surveyors and members of the Board of Directors, conducted a spot level survey at my residence in Vistana Heights. However, despite my requests, I have not yet received the survey report. A letter from LJS dated 15 January 2025 stated that the Board is still reviewing my complaint pending "further verification from the authority," but my inquiries about the identity of this authority remain unanswered.

Since 2022, I have been corresponding with DBKK to address these concerns but received no response until I escalated the matter to the Integrity Department in February 2025. A meeting was convened by the Director of DBKK on 5 May 2025, followed by another on 11 June 2025, attended by two officers from the Integrity Department. During the latter meeting, figures not present in the original as-built survey plan were presented to suggest compliance. However, my question regarding whether DBKK had mandated the construction of the retaining wall, as recorded in the minutes of the 5 May 2025 meeting, remains unanswered despite being assigned for action by DBKK’s engineer and town planner.

As the deadline for legal action approaches on 2 October 2025, I am eager to resolve this matter amicably. I have requested a meeting with the Integrity Department, but this has not yet been arranged.

Tan Sri, I would be deeply grateful for your guidance on how I might proceed to resolve these issues in a constructive and cooperative manner. Your advice would be invaluable in helping me navigate this situation.

Since 2022, I have repeatedly urged the developer of Vistana Heights to honor commitments made by the late Robert Lee and Jessy Lee to construct a retaining wall behind the residential units S1 to S18, (now renamed D17 to D18).

Dear Datuk Seri Dr Samin Samitah,

I have written several emails to you at mayor@dbkk.sabah.my and had never received any response.

What your staff members are doing is detrimental to you and the Government of Sabah. They are misleading others to cover up their deceit in approving the occupancy certificate of Vistana Heights.

Since 2022 I have tried to resolve matters amicably to no avail.
