Responsibility of a Principal Submitting Person

Dear Sir,

I refer to your email dated 14.10.22 copied below for your convenience.

I would appreciate it if you could let me know what additional information you require to comment on my email to you on 22.8.2022.

There is no legal dispute between the developer and me/my son. As such this should not be an excuse not to answer my questions below.

On 5.6.24 I met with the architect AR. Lee Yik Soon of LYS architect and said that he as the Principal Submitting Person should be responsible for documents submitted to the Approved Local Authority.

He believes that he is not responsible for submitting any documents extended to him by other professionals including the surveyor who prepared the As-built- Survey.

I intend to write to MACC and/or take legal action against the developer and the other professionals responsible for the development of Vistana Heights Phase 1.

I would like to attach your reply to my questions below to MACC.

I request you to please let me know if the Principal Submitting Person, in this case the architect, who submitted the As-built-Survey to the local authorities is liable, for mistakes in the drawing.

In addition, I would be grateful if you would address the following questions as well.

i.                     Is there a maximum gradient that an architect and engineer should adhere to when constructing a driveway?

ii.                   Should the professionals such as the architect involved in a construction project not be held responsible for wrong construction of driveways that are not in accordance with original drawings?

The above are questions that I believe you should be able to answer without having to obtain further information.

Dear Mr. Luqman,

We refer to your query as received on the 29th August 2022 and would reply as follows:

1.  Please accept our apologies for the delay in replying. The delay though was a result of our trying to obtain a bit more information regarding the technical issues behind your query.

2.  Based on the information received from PAM's Sabah Chapter, we understand that the Architect in question has already provided his findings and replied to the Developer regarding the issues which you have highlighted. Under normal circumstances, we would advise that you pursue your queries as such, with the Developer or the local authority tasked with control of the construction of the property.

3.  We have also been led to understand that there is a current, legal dispute between yourself and the Developer. Apart from not being able to comment based on the information we have received we hope you understand that we are also unable to add any further advice lest it may be misconstrued as interference within the above-mentioned dispute.
