Homeowners Association (HOA)



 

An HOA is a private entity that manages residential communities, typically those with shared amenities or infrastructure.

In 2022, a DBKK engineer recommended forming an HOA to address collective concerns at Vistana Heights. I discussed the idea with several homeowners who initially supported it, and I began drafting a constitution. However, their enthusiasm waned after a homeowner, instrumental in securing the occupancy certificate, persuaded them against the HOA. Since then, I’ve been working alone.

Despite my efforts, the homeowners remain unconvinced, their minds seemingly set. Even a new homeowner has ignored my request to meet, likely influenced by others. Don’t they realize we won’t receive property titles without meeting DBKK’s stipulations? Don’t they see the risk of Vistana Heights being deemed uninhabitable due to ongoing erosion since 2011?

Attached is an image of the drainage reserve (as-built survey) behind houses D17 to D18, and a recent photo of House D17. The 9-foot drainage reserve has completely eroded. DBKK’s notice confirms that individual titles will only be issued once all requirements are met.

The back boundary of S8 to S3 have been reduced by 6 feet and this too is not depicted in the amended development plan dated 2018.  


 
 
 
  
 
 


 
Oops! What happened to the trees that were said to protect the cliff from slipping? Our naive buyers will believe anything 'professionals' say. They cannot think for themselves.

A moment ago I read an article in The Edge that all are equal before the law. This is good news as I have initiated legal action against DBKK for approving the occupancy certificate for Vistana Heights based on fabricated as-built survey.

The article said: 'On article 8, which guarantees equality before the law, the judge highlighted that all were equal before the law and that the civil suit adhered to the standard "procedural and substantive law" that is applicable to everyone.
