Dear YB Datuk Shafie,

On 15.1.2025, I received an email from Lembaga Juruukur Sabah which states the following.

'Please be informed that the Board is still looking into your complaint about the As-built survey plans for Taman Puncak Vistana, Iramanis due to further verification from the authority.' 

The occupancy Certificate was obtained by submitting a fabricated as-built survey plan to DBKK.

This project was approved during your term as Chief Minister.

Can you shed some light on who is the authority that LJS is waiting to verify?

My son bought a house and it has been vacant since the OC was issued in 2019.

I would appreciate a response to this email immediately.

YB Datuk Shafie yang dihormati,

Pada 15.1.2025, saya menerima e-mel daripada Lembaga Juruukur Sabah yang menyatakan seperti berikut:

'Dimaklumkan bahawa Lembaga masih dalam proses menyiasat aduan anda mengenai pelan tinjauan As-built untuk Taman Puncak Vistana, Iramanis kerana memerlukan pengesahan lanjut daripada pihak berkuasa.'

Sijil Menduduki telah diperoleh dengan menyerahkan pelan tinjauan As-built yang dipalsukan kepada DBKK.

Projek ini telah diluluskan semasa anda menjawat jawatan Ketua Menteri.

Bolehkah anda memberikan pencerahan mengenai pihak berkuasa yang sedang ditunggu oleh LJS untuk pengesahan?

Anak saya telah membeli sebuah rumah dan ia telah kosong sejak Sijil Menduduki dikeluarkan pada tahun 2019.

Saya amat menghargai jika anda dapat membalas e-mel ini dengan segera.

Are architects liable for fabricated documents submitted to authorities

In 2020, many of my well-meaning friends told me that I have no course of action against the professionals involved in obtaining the Occupancy Certificate for Vistana Heights project with fabricated as-built survey plan. I believe all those involved, including DBKK senior officers, LPPB (Lembaga Pembangunan Perumahan Dan Bandar) and its GM Rosemary Ahping, Arkitek LYS, Lembaga Juruukur Sabah etc. will be answerable for how the Occupancy Certificate was issued. Hopefully, my complaint to SPRM (MACC), LJS, DBKK, Lembaga Arkitek Malaysia will be looked into.
