Subject: Urgent Demand for Resolution Regarding Vistana Heights Issues and Development Plan Discrepancies

 

Dear Mr. Stanley Chong,

I am writing to express my extreme dissatisfaction with the ongoing unresolved issues concerning Vistana Heights since 2022, despite my exhaustive efforts to seek a resolution. Your inaction and the apparent negligence of your office are unacceptable.

During our telephone conversation on February 16, 2023, you acknowledged the gravity of the situation, stating that if the occupancy certificate for Vistana Heights was obtained fraudulently, it constitutes a serious matter. I documented this discussion in an email sent the same day. Yet, no progress has been made.

Since May 2022, I have repeatedly raised concerns about the dangerously steep driveway with the developer, architect, and engineer, to no avail. In August 2022, I wrote to Mr. Saiman Anggak of DBKK and received no response. In September 2022, I contacted the mayor to request a meeting about the unbuilt retention wall promised by the developer, which remains unresolved.

To substantiate claims of fraud, I repeatedly requested the development plan attached to my son Faisal’s Sales & Purchase Agreement from Puan Tantinny Fung, Director of the City Planning Department, starting October 6, 2022, and again twice in April 2025. I also requested the same from the developer and architect on October 6, 2022. It was only after my complaint to Sr. Lifred Wong of DBKK on May 5, 2025, and his instruction to Architect LYS, that I finally received the plan on May 13, 2025.

Upon reviewing the development plan dated March 8, 2011, authorized by then-Mayor Datuk Abidin Madingkir, I confirmed it matches the original 1995 plan regarding platform heights. However, the final 2018 development plan, which you personally checked and which was approved by Datuk Yeo Boon Hai, deviates significantly from both the 1995 and 2011 plans. I demand an immediate explanation for the following:

On what grounds did you check and sign the 2018 development plan, which differs from the 1995 and 2011 plans?

Why was the 2011 development plan withheld from me until May 2025, and only provided after I escalated the matter to the Integrity Department?

I have repeatedly urged you, LPPB, Architect LYS, and DBKK to resolve this matter amicably. This is your final opportunity to address these discrepancies and settle this issue before I proceed with legal action. Your prompt response and action are non-negotiable.
