Invalidation of occupancy certificate
An occupancy certificate can be invalidated or revoked under specific circumstances, typically related to non-compliance with building codes and regulations. Common matters that may lead to the invalidation of an occupancy certificate include:
Non-Compliance with Building Codes or Regulations:
The building or structure fails to meet the approved plans, local building codes, zoning regulations, or safety standards identified during inspections after the certificate was issued.
My thoughts:
The platform height stated on the Sales and Purchase Agreement is 101 feet. The final development states it is 106.26 feet. This does not meet the approved plan dated 2007 that was attached to the Sales & Purchase Agreement.
As for safety standards the developer promised a retaining wall but did not construct it. The retaining wall is proposed in the development plan dated 2018 and signed by the mayor, Datuk Yeo Boon Hai.
Unauthorized modifications or alterations to the building that deviate from the approved plans without proper permits or approvals.
My thoughts:
Did DBKK give permission for the illegal driveways extending onto the access road?
Did DBKK give permission for buildings to be extended to the back of the wall? This extension will create more pressure on the ground and may cause the back of the hill to collapse.
Failure to complete required construction or inspections as stipulated in the certificate.
Here are two forms submitted to DBKK by the Engineer for request of occupancy certificate:
i. Dengan ini saya mengesahkan bahawa penyeliaan dibuat terhadap kerja-kerja pembinaan dan menyiapkan tembok penahan/ perlindungan cerun, dan sepanjang pengetahuan yang saya ketahui kerja-kerja tersebut adalah mengikut spesifikasi dan pelan yang di luluskan oleh Dewan Bandaraya Kota Kinabalu. Saya mengaku bertanggungjawap sepenuhnya terhadap setiap bahagian yang berkaitan dengan saya termasuk lukisan rekabentuk, pemeriksaan tanah (soil investigation) dan perlaksanaan kerja.
Translation:
I hereby confirm that supervision was carried out on the construction and completion of the retaining wall/slope protection, and to the best of my knowledge, the works were executed in accordance with the specifications and plans approved by the Kota Kinabalu City Council. I acknowledge full responsibility for all aspects related to me, including design drawings, soil investigation, and work implementation.
ii. On submission for request for occupancy certificate for structure:
Dengan ini saya mengesahkan bahawa penyeliaan telah dibuat terhadap kerja-kerja pembinaan dan penyiapan bangunan/struktur tersebut dan sepanjang pengetahuan yang saya ketahui kerja-kerja tersebut adalah mengikut spesifikasi pembinaan. Syarat kelulusan dan pelan struktur yang didaftarken atau diluluskan. Saya mangaku bertanggungjawap sepenuhnya terhadap setiap bahagian yang berkaitan dengan saya termasuk lukisan rekabentuk serta pemeriksaan tanah (soil investigation) dan perlaksanaan kerja.
Translation:
I hereby confirm that supervision has been carried out on the construction and completion of the building/structure, and to the best of my knowledge, the works were executed in accordance with the construction specifications, approval conditions, and the registered or approved structural plans. I acknowledge full responsibility for all aspects related to me, including design drawings, soil investigation, and work implementation.
Process for Invalidation: Invalidation typically involves an inspection, notice of violation, and a formal revocation by the issuing authority. Owners may be given a chance to rectify issues before revocation.
Consequences: An invalidated occupancy certificate may result in fines, closure of the building, or legal action until compliance is restored.
