Dear Mr. Stanley Chong,

I write to express my disappointment regarding the postponed meeting scheduled for 5 August 2025, which has yet to be rescheduled. I remain puzzled as to why this matter—plagued by significant flaws in the development plans, as-built survey plan, Form A/RS, and the minutes of the DBKK meetings dated 5 May 2025 and 11 June 2025—cannot be resolved amicably.

 

To avoid breaching the time bar, my lawyer will file the writ of summons next week.

 

For context, the initial development plan for the Vistana Heights project dates back to 1995. By 1997, a soil test had been conducted by Applied Geotechnics (Sabah) Sdn. Bhd. Pursuant to this test (as referenced in Item 6 of the MPKK circular dated November 1997 on the development plan), a retaining wall was mandated. This requirement is explicitly noted in Item 9 of the 2018 development plan, which was reviewed and signed by Mr. Stanley Chong, then Director of the DBKK Planning Section (Jabatan Perancangan), and approved by Datuk Yeo Boon Hai on 3 October 2018.Item 9 states as follows:

 

"Retaining wall will be provided along boundaries of different levels between the development site and the adjacent land with min 6’ setback from the land title boundary of the proposed development site."

 

 A land title boundary delineates the outer legal limits of the entire property.

 

Furthermore, the engineer, Mr. Heng Kok Keong of Zaidun Leeng (Sabah) Sdn. Bhd., signed the Form A/RS—Perakuan Kerja Siap—Tembok Penahan & Perlindungan Cerun, certifying:

"Dengan ini saya mengesahkan bahawa penyeliaan telah dibuat terhadap kerka-kerja pembinaan dan menyiapkan tembok penahan/perlindungan cerun, dan sepanjang pengetahuan saya ketahui kerja-kerja tersebut adalah mengikut spesifikasi dan pelan yang di luluskan oleh Dewan Bandaraya Kota Kinabalu. Saya mengaku bertanggungjawab sepenuhnya terhadap setiap bahagian yang berkaitan dengan saya termasuk lukisan rekabentuk, pemeriksaan tanah (soil investigation) dan perlaksanaan kerja."

 

Regrettably, no retaining wall was constructed.  Additionally, Item 16 of the development plan states:

"The final finished ground levels of the development have been clearly indicated on the drawing."

 

The November 1997 circular pertains to the 1995 development plan, under which the house platform height was specified as 101 feet—not 106.26 feet, as indicated in the 1998 development plan.
