Update on My Complaint to the Selangor Education Department – Some Good News

 



On 6 June 2026, I sent an official complaint via email to the Director of Education, Selangor, followed by a registered letter on 8 June 2026.After receiving no reply, I followed up with another email this morning,19.6.2026, and a telephone call. The Director’s Personal Assistant, Puan Aliah, who answered my call, informed me that the Director has instructed the complaint to be forwarded to the Integrity Department for further action. I asked her to acknowledge receipt of my email and have yet to receive it. 

Now, I'll wait for another two weeks to see if this matter has to be escalated.  

For those who missed my earlier post, below is the English translation of the email and formal letter I sent to the Director.

DISCIPLINARY COMPLAINT: FAILURE TO COMPLY WITH HIGH COURT OF MALAYA ORDER AND SERIOUS FINANCIAL INDEBTEDNESS BY A PUBLIC SERVANT  NAME OF OFFICER: xxx A/P xxx (Name withheld)

With due respect, the above matter is referred to.  On behalf of the Plaintiff’s family, I wish to report a serious disciplinary breach by a public officer under the supervision of your Department/Ministry, namely Puan xxx A/P xxx, who is currently serving as a teacher at the above-mentioned school.  Attached to this letter is a copy of the High Court of Malaya Order at Shah Alam (Appendix 27) dated 19 May 2023 in Case No: BA-24NCVC-740-05/2022.  Under clause (ii) of the said Order, the Court directed Puan xxx to pay the sum of RM3,000.00 as costs of the action to the Plaintiff. For Your Honour’s information, as at the date of this complaint (more than three years after the order was issued), Puan xxx has continuously failed, neglected, and refused to settle the said judgment debt despite repeated demands.  Her willful disregard of an official order from the country’s judicial institution constitutes misconduct that tarnishes the image of the public service. Failure to settle this judgment debt is a clear violation under Regulation 13 of the Public Officers (Conduct and Discipline) Regulations 1993 [P.U.(A) 395/1993], which prohibits a public officer from being in a state of serious financial indebtedness arising from any unsatisfied judgment debt within the stipulated period.  In view of the above, we respectfully request that the Selangor State Education Department and the Integrity Unit of the Ministry of Education take appropriate internal disciplinary action against the said officer and direct her to comply with the law by settling the judgment debt of RM3,000.00 immediately.  Your Honour’s cooperation, attention, and firm action in this matter are highly appreciated in order to uphold the integrity and professionalism of the nation’s teaching profession.

Dengan segala hormatnya, perkara di atas adalah dirujuk.Saya bagi pihak keluarga Plaintif ingin melaporkan masalah pelanggaran tatatertib serius oleh pegawai di bawah seliaan pihak Jabatan/Kementerian, iaitu Puan xxx A/P xxx, yang kini berkhidmat sebagai guru di sekolah tersebut di atas. Bersama-sama surat ini dilampirkan salinan Perintah Mahkamah Tinggi Malaya di Shah Alam (Lampiran 27) bertarikh 19 Mei 2023 di bawah Kes No: BA-24NCVC-740-05/2022.

Di bawah klausa (ii) Perintah tersebut, Mahkamah telah mengarahkan Puan xxx untuk membayar kos tindakan sebanyak RM3,000.00 kepada pihak Plaintif. Untuk makluman pihak YBhg. Datin, sehingga tarikh aduan ini dibuat (iaitu selepas lebih tiga tahun perintah dikeluarkan), Puan Veni tetap gagal, cuai, dan enggan melunaskan hutang penghakiman tersebut walaupun tuntutan telah dibuat berulang kali. Tindakan beliau yang ingkar kepada perintah rasmi institusi kehakiman negara adalah satu bentuk salah laku yang menjejaskan imej perkhidmatan awam.Kegagalan menyelesaikan hutang penghakiman ini merupakan suatu bentuk pelanggaran nyata di bawah Peraturan 13, Peraturan-Peraturan Pegawai Awam (Kelakuan dan Tatatertib) 1993 [P.U.(A) 395/1993], di mana seorang penjawat awam dilarang berada dalam keadaan keterhutangan kewangan yang serius akibat daripada sesuatu hutang penghakiman yang tidak dijelaskan dalam tempoh yang ditetapkan.

Sehubungan dengan itu, kami memohon jasa baik pihak Jabatan Pendidikan Negeri Selangor dan Unit Integriti KPM untuk mengambil tindakan tatatertib dalaman yang sewajarnya terhadap pegawai tersebut, serta mengarahkan beliau untuk mematuhi undang-undang dan menyelesaikan hutang penghakiman RM3,000.00 ini dengan kadar segera.Kerjasama, perhatian, dan tindakan tegas daripada pihak YBhg. Datin amatlah dihargai demi menjaga integriti dan profesionalisme perguruan negara.

If you have a Court Judgement that was been served on the opposing party and they fail to comply with an Order to pay, then the next course of action is to execute the Judgement. Your lawyer can advise you on the ways of doing so.
We also do not know if the Judgement for the case arose as a result of a personal/private action of the opposing party or in the course of her duties as a teacher. If it's NOT due to her actions as a teacher, then I don't think the Education Department/Ministry should be involved. Find other ways to get your costs from her.

True, execution of judgment is the legal route. But my concern is bigger than just recovering RM3,000. A teacher who ignores a High Court order for years is not simply a private litigant — she is a public servant. The Ministry may not interfere in the litigation, but it cannot dismiss the issue as “private” when it touches on integrity and accountability. Teachers are role models, and compliance with court orders is the bare minimum standard expected of them.

If we have taken in appropriate persons into the education system of Malaysia in the first case, there is no need to deal with such cases. Why is this happening? Wrong selection criteria

This is my reply:
Moses Choo You’re right — wrong selection criteria is part of the problem. But the deeper issue is accountability. Even if someone slips through the system, there must be consequences when a teacher ignores a High Court order. Otherwise, the message to students is that rules don’t matter. Selection must improve, yes, but enforcement of integrity standards is equally critical.

Moses Choo But this is also a test: if a teacher can ignore a High Court order without consequence, what happens when other civil servants file fraudulent information in affidavits? Selection must improve, but enforcement of integrity standards is the real measure of whether the system protects the public or tolerates dishonesty.... The same thing that is happening in Sabah is happening in West Malaysia. In 2022 I wrote several emails to the head mistress of SK Kuchai. She did not reply even a single one. I also wrote to MOF who played pass the ball and asked me to report to PDRM.
What prevents public administrators from resolving matters before they escalate?

Finally, Yesterday,I received a reply from the Integrity Department. They had completely misunderstood my email despite it being written in Malay.
It was a cover up.
I will post they reply soon.
