Meeting at KKTP cancelled

My wife and I were looking forward to the meeting at 2.30 pm when I received an email at 10.43 am and a telephone call a few minutes later saying the meeting scheduled for 2.30 pm has been postponed.

I was, to put it mildly, disappointed.

Here is the email from KKTP and my reply.

Dear Ms. Lee Tsun Min,

Thank you for your letter dated 5 August 2025, cancelling our scheduled meeting on the same day. I am writing to express my concern regarding the approaching deadline for filing a case against the developer and other involved parties. Enclosed are emails sent to the mayor and other relevant parties, which I recommend be reviewed by the Attorney General, State Secretary, Mr. Stanley Chong, and the mayor prior to our next meeting. I kindly request that these emails not be shared with the developer or architect.

The purpose of the next meeting should be to reach a solution, rather than further discussing the issues. If there are any questions regarding the enclosed emails, please address them before the meeting, as time is critical.

Background Information:

·The initial Development Plan (DP) was prepared in 1995 and approved by the mayor on 27 November 2006, listing Topwira Corporation Sdn Bhd and LPPB as owners.

·Following a soil test by Applied Geotechnics (Sabah) Sdn Bhd, DBKK (then MPKK) mandated a retaining wall along boundaries of varying levels, with a minimum 6-foot setback from the land title boundary.

·A revised DP, dated February 2007, was approved by Datuk Abidin Madingkir on 8 March 2011, signed only by Topwira (not LPPB). The house platform and road heights matched the 1995 DP and were included in my son Faisal’s Sale and Purchase Agreement (S&P).

·Upon project completion, a 2018 DP, checked by Mr. Stanley Chong and approved by Dr. Yeo Boon Hai, reiterated the retaining wall directive and was signed by both.

When my son signed the S&P in January 2014, the platform was completed, and the houses were certified 75% complete. The DP attached to the S&P indicated a platform height of 101 feet. However, the 2018 DP shows the actual height as 106.26 feet, constituting fraudulent misrepresentation.

Given these discrepancies and the issues outlined in the enclosed emails, I am surprised that my requests for an amicable resolution have not been addressed. Since 2022, I have sought to resolve this matter out of court to protect the reputation of our government. I now urge you to propose an effective solution.

Yours sincerely,

Luqman Michel

Note now: I will post the attached emails in my next post.
