Dear Sir,

 

I am writing to seek your intervention regarding unresolved issues at Vistana Heights, Kota Kinabalu, as detailed in my email to the Jabatan Perkhidmatan Awam (JPA) on 30 June 2025 and subsequent correspondence with the Lembaga Juruukur Sabah (LJS) and Land and Survey Department (L&S). These issues include a non-compliant driveway, a missing retaining wall, and discrepancies in the as-built survey, which remain unaddressed despite efforts since October 2019.

 

My email to JPA highlighted safety concerns due to an excessively steep driveway and the absence of a mandated retaining wall, as well as the lack of response from Dewan Bandaraya Kota Kinabalu (DBKK), LJS, and L&S. (NOTE 1)

 

On 7 August 2025, I sought clarification from L&S (Ref: LJS. 20 Vol. 1/85) regarding anomalies in the as-built survey and the identity of an “authority” referenced in LJS’s 15 January 2025 letter.

The LJS reply dated 14 August 2025, signed by Dato’ Sr. Bernard Liew Chau Min, stated that I could appeal to the Court under Section 17 of the Surveyors Ordinance 1960 if dissatisfied, but it failed to address key discrepancies, such as height differences at Units S7 and S9, platform height variations, and the late 2018 approval of the 1998 development plan.

Civil servants from DBKK, LJS, and L&S have provided conflicting statements—e.g., DBKK denying it is the “authority” while LJS initially suggested otherwise—and have not supplied the June 2023 spot level survey results despite my requests. This lack of transparency and accountability, noted in meetings on 5 May and 11 June 2025, contradicts JPA guidelines reported in The Star on 10 June 2025, which emphasize resolving public concerns discreetly. I request that Jabatan Perkhidmatan Awam Negeri Sabah:

 

Investigate the conduct of civil servants at DBKK, LJS, and L&S for their failure to resolve these issues.

 

Clarify the identity of the “authority” referenced by LJS and ensure transparency.

 

Ensure adherence to JPA directives for constructive dialogue.
